These Terms & Services (“Terms”) govern your access to and use of the website timespringapp.com, mobile applications, studio facilities, online classes, retail shop, and related services (collectively, the “Services”) operated by TimeSpring (“TimeSpring,” “we,” “us,” or “our”). By registering for membership, purchasing products, booking classes, or browsing the site, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least sixteen years old to use the Services, or the age of majority in your jurisdiction if higher. Members under eighteen require consent from a parent or legal guardian. You are responsible for maintaining the confidentiality of login credentials and for all activity under your account. Notify us immediately at hello@timespringapp.com if you suspect unauthorized access.
Information you provide must be accurate and kept current. We may suspend or terminate accounts that contain false information, violate these Terms, or pose a safety risk to staff or other members.
Physical exercise involves inherent risks including injury, illness, or aggravation of pre-existing conditions. You represent that you are physically able to participate and that you have consulted a qualified health professional when appropriate. TimeSpring coaches are not medical doctors unless explicitly stated; coaching does not constitute medical advice, diagnosis, or treatment.
You must disclose relevant health conditions, injuries, pregnancies, or medications that may affect training. We may require a physician clearance before participation. You assume voluntary assumption of risk for all activities undertaken at our studio, partner locations, or through online programming.
Membership tiers, fees, and included benefits are described on our Pricing page and in your enrollment confirmation. Fees are billed monthly or annually as selected unless otherwise stated. By providing payment authorization, you authorize recurring charges until you cancel according to these Terms.
Promotional rates such as percentage discounts apply only to eligible first-time individual memberships unless noted. Promotions cannot be combined, transferred, or applied retroactively. TimeSpring may modify or withdraw promotions at any time.
Members may cancel by written notice through the contact form or email. Cancellation takes effect at the end of the current billing period unless local consumer laws require otherwise. Pause requests are subject to plan limits and available slots. Failure to cancel before renewal may result in charges for the next period.
Except where required by law, membership fees are non-refundable once a billing period begins. Unused sessions, classes, or guest passes expire as stated in your plan documents.
Class schedules may change due to instructor availability, holidays, or maintenance. We strive to provide reasonable notice of cancellations. Members must book and cancel within the windows stated on the site or app. Repeated late cancellations or no-shows may incur fees or booking restrictions.
You agree to treat staff and members with respect, follow coach instructions, use equipment safely, and wear appropriate attire. Harassment, discrimination, intoxication, recording others without consent, or misuse of equipment may result in immediate removal and termination without refund.
Personal training and virtual coaching are subject to separate scheduling policies. Sessions expire according to your package terms. Rescheduling requires advance notice; late cancellations may forfeit the session. Online coaching relies on accurate self-reporting and video submissions; we cannot guarantee outcomes and do not warrant specific fitness results.
Product descriptions, images, and prices on the shop page are for informational purposes. The demo checkout on timespringapp.com stores cart data locally in your browser and does not process live payments. When live commerce is enabled, separate purchase terms including shipping, taxes, and returns will apply.
Submitting a checkout request indicates interest in products; a representative may contact you by email to confirm availability, pricing, and delivery. Title and risk of loss pass upon delivery as defined in final order confirmations.
All content on the Services—including logos, workout plans, videos, text, graphics, and software—is owned by TimeSpring or licensed to us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access content for personal, non-commercial use while your membership is active.
You may not copy, distribute, publicly perform, create derivative works, scrape data, or reverse engineer any part of the Services without written permission. The TimeSpring name and logo may not be used in a manner that implies endorsement without consent.
If you submit testimonials, photos, comments, or other content, you grant TimeSpring a worldwide, royalty-free license to use, reproduce, and display that content for marketing and operational purposes. You represent that you own or have rights to the content and that it does not violate privacy or publicity rights of others.
We may remove content that is offensive, misleading, or infringes third-party rights.
The Services may link to social networks, payment processors, or partner apps. We are not responsible for third-party terms, privacy practices, or availability. Your use of third-party services is at your own risk.
Our collection and use of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMESPRING AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO TIMESPRING IN THE TWELVE MONTHS PRECEDING THE CLAIM OR ONE HUNDRED LOCAL CURRENCY UNITS, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
You agree to indemnify and hold harmless TimeSpring from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, violation of law, or injury caused by your negligence.
We may update these Terms to reflect new features, legal requirements, or business practices. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance. If you disagree, you must stop using the Services and cancel your membership.
These Terms are governed by the laws applicable in the jurisdiction where TimeSpring is registered, without regard to conflict-of-law principles. Parties will attempt good-faith resolution before pursuing formal proceedings. Where permitted, you agree to bring claims only in competent courts of that jurisdiction.
If any provision is held invalid, the remaining provisions remain in effect. These Terms, together with membership confirmations and the Privacy Policy, constitute the entire agreement between you and TimeSpring regarding the Services.
